These terms govern your use of mgtrusted.co.uk (the "Platform"), operated by MGtrust ("MGtrust", "we", "us"). By creating an account or using the Platform, you agree to these terms. If you do not agree, please do not use the Platform.

1. What MGtrust is

MGtrust is an online marketplace that lets private sellers and trade partners ("Sellers") advertise vehicles for sale, and lets buyers ("Buyers") search, enquire about, and purchase vehicle history checks on those vehicles.

MGtrust is not a party to any sale of a vehicle between a Seller and a Buyer. We provide the platform, listing moderation, seller identity verification, and optional vehicle history checks — but the contract for the sale of a vehicle is between the Buyer and the Seller alone. MGtrust does not own, inspect, or take title to any vehicle listed on the Platform, and is not responsible for the condition, legality, or accuracy of any listing beyond the moderation checks described below.

2. Accounts and eligibility

• You must be at least 18 years old to create an account.
• You must provide accurate, current information when registering.
• You are responsible for keeping your password secure and for all activity under your account.
• Private sellers and trade partners must complete identity verification before their first listing is published.

3. Listings and seller responsibilities

As a Seller, you are solely responsible for the accuracy of your listing, including the vehicle's specification, condition, mileage, history, and price. Listings must comply with the Consumer Rights Act 2015, the Consumer Protection from Unfair Trading Regulations 2008, and all other applicable UK consumer protection law. Misleading, false, or fraudulent listings are prohibited and will be removed.

Every listing is reviewed by our moderation team before it goes live. Moderation approval is not a certification of a vehicle's condition, roadworthiness, or value — it confirms only that the listing meets our content and accuracy guidelines at the time of review. MGtrust may reject, suspend, or remove any listing at its discretion, including after it has gone live.

4. Buyer responsibilities

Buyers are responsible for carrying out their own checks on a vehicle before agreeing to purchase it, including viewing the vehicle in person and arranging an independent inspection where appropriate. A vehicle history check purchased through the Platform is an aid to that decision, not a substitute for it.

5. Vehicle history checks

Vehicle history check reports are compiled from available third-party data sources and are provided for informational purposes only. MGtrust and its data providers do not guarantee that a report is complete, error-free, or up to date, and accept no liability for decisions made in reliance on a report. Vehicle history check fees are charged at the time of purchase and are non-refundable once a report has been generated.

6. Fees and payments

• Listing fees, featured-listing upgrades, and vehicle history check fees are charged per transaction and are non-refundable once the associated service has been delivered (for example, once a listing has been published or a report generated).
• Trade partner subscriptions are billed on a recurring basis until cancelled. You can cancel or manage your subscription at any time from your dashboard, and cancellation takes effect at the end of the current billing period.
• All fees are shown inclusive of any applicable VAT unless stated otherwise.
• Payments are processed securely by Stripe.

7. Prohibited conduct

• Listing a vehicle you do not own or have authority to sell.
• Posting false, misleading, or duplicate listings.
• Attempting to circumvent moderation, verification, or payment processes.
• Harassing, threatening, or defrauding other users.
• Using the Platform for any unlawful purpose.

We may suspend or terminate accounts that breach these terms, remove offending content, and where required, report unlawful activity to the relevant authorities.

8. Reviews and ratings

Reviews left on the Platform must reflect a genuine transaction or interaction. Fake, incentivised, or retaliatory reviews are prohibited and may be removed.

9. Intellectual property

The MGtrust name, logo, and Platform design are the property of MGtrust. Content you upload (such as listing photos and descriptions) remains yours, but by posting it you grant MGtrust a licence to display it on the Platform for the purpose of operating the marketplace.

10. Limitation of liability

To the fullest extent permitted by law, MGtrust is not liable for any loss arising from a transaction between a Buyer and a Seller, the condition or roadworthiness of any vehicle listed, or the accuracy of any listing or vehicle history check report. Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.

11. Termination

You may close your account at any time. We may suspend or terminate your access to the Platform if you breach these terms, or where necessary to protect the safety or integrity of the Platform.

12. Governing law

These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
